1. Scope and acceptance

These Terms & Conditions govern your access to the Easy Gym Software website, software services and related support. By using them, or by accepting an order form or subscription agreement that incorporates these terms, you agree to comply with them. If you use the services for an organisation, you confirm that you are authorised to accept them for that organisation.

A signed order form, subscription agreement or other written agreement may contain additional terms. If it conflicts with these website terms, the written agreement applies to the extent of the conflict.

2. Accounts and customer responsibilities

You are responsible for providing accurate account information, protecting login credentials and controlling the permissions you assign to your staff. You must notify us promptly if you suspect unauthorised access to an account.

You are responsible for the information you enter into the services, including having the necessary rights and notices to collect and use member, staff and prospect information. You must use the services in accordance with applicable laws and your agreements with your members and staff.

3. Acceptable use

You must not misuse the services. In particular, you must not attempt to gain unauthorised access, interfere with service availability, introduce malicious code, reverse engineer except where law permits it, infringe another party’s rights, or use the services for unlawful, abusive or deceptive activity.

4. Fees, subscriptions and changes

Fees, billing cycle, renewal, taxes, cancellation and any trial terms are stated in the applicable order form, invoice or subscription arrangement. You are responsible for applicable taxes unless the law requires otherwise. We may update these website terms by posting a revised version; changes to paid subscriptions are subject to the applicable written agreement and applicable law.

5. Intellectual property and feedback

Easy Gym Software and its licensors retain rights in the services, software, branding and site content. Subject to these terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use the services during your subscription. You retain rights in your data. If you provide feedback, you allow us to use it to improve our services without an obligation to you.

6. Availability, support and third-party services

Service availability, support scope, integrations and any service levels are only those expressly stated in the applicable subscription documents. Third-party services, payment providers and messaging channels may have separate terms and may change independently of Easy Gym Software.

7. Suspension and termination

We may suspend access where reasonably necessary to protect the services, investigate a suspected breach, respond to a legal requirement or address non-payment. Where practicable, we will provide notice. Termination, data export and deletion are governed by the applicable subscription documents and our Privacy Policy.

8. Disclaimers, liability and contact
